SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A., in anagram SETRAM, with CIF A08766099 and address at Calle Y, Tramo VII, Edificio Setram, Puerto de Barcelona, 08040-Barcelona, (hereinafter, the Data Controller), is the entity responsible for the processing of data provided by customers of the Application (hereinafter, the User\/s).<\/p>\n
Purpose of data processing<\/h3>\n
To proceed with the registration, access and subsequent use of the Application, the User must provide -on a voluntary basis-, personal data (essentially, identification and contact), which will be incorporated into automated media owned by SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A.<\/p>\n
In addition, this application has an optional location service that allows for efficient transport management, with the possibility of consulting the status of the cargo, delivery deadlines, incidents on the road and establishing alternative routes. This generates a direct communication channel between the carrier and the customer, reliable and fast, which minimizes costs and speeds up services. <\/p>\n
The collection, storage, modification, structuring and elimination of the data provided by the Users, as well as those obtained by geolocation, if applicable, will constitute processing operations carried out by the Responsible Party, with the purpose of guaranteeing the correct functioning of the Application, maintaining the service provision and\/or commercial relationship with the User, and for the management, administration, information, provision and improvement of the service.<\/p>\n
Legitimation<\/h3>\n
The processing of the User’s data is carried out with the following legal bases that legitimize it:<\/p>\n
\n- The request for information and\/or the contracting of the services of the Application, whose terms and conditions will be made available to the User in any case, in advance, for their express acceptance.<\/li>\n<\/ul>\n
\n- The free, specific, informed and unequivocal consent of the User, by making this privacy policy available to him\/her, which he\/she must accept by means of a statement or a clear affirmative action.<\/li>\n<\/ul>\n
If the User does not provide SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. with his\/her data, or does so incorrectly or incompletely, it will not be possible to proceed with the use of the Application.<\/p>\n
Retention of personal data<\/h3>\n
The personal data provided by the User will be kept in the systems and databases of the Data Controller for as long as the User continues to use the Application, and as long as the User does not request its deletion. In order to purge the possible responsibilities derived from the treatment, the data will be kept by legal requirement for a minimum period of five years. <\/p>\n
The data will not be disclosed to any third party outside the SETRAM Group, unless required by law or, in any case, upon request of the User’s consent.<\/p>\n
On the other hand, SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. may give access to or transmit the personal data provided by the User to third party service providers, with which it has signed data processing agreements, and that only access such information to provide a service for and on behalf of the Responsible.<\/p>\n
Protection of hosted information<\/h3>\n
The Data Controller, adopts the necessary measures to ensure the security, integrity and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and, in the Organic Law 3\/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights.<\/p>\n
Although the Responsible Party makes backup copies of the contents hosted on its servers, however, it is not responsible for the loss or accidental deletion of data by Users. Likewise, it does not guarantee the total replacement of data deleted by Users, since such data may have been deleted and\/or modified during the period of time elapsed since the last backup. The services provided or rendered through the Application, except for the specific backup services, do not include the replacement of the contents kept in the backup copies made by the Data Controller, when this loss is attributable to the User. <\/p>\n
Exercise of rights<\/h3>\n
The User may exercise his\/her rights of access, rectification, opposition, deletion (“right to be forgotten”), limitation of processing and portability, by sending an e-mail to the address: ProteccionDatos@setram.com;<\/a><\/u><\/strong> or by sending a letter by post to the address: Calle Y, Tramo VII, Edificio Setram, Puerto de Barcelona, 08040 (Barcelona); indicating as reference LOPD SETRAM. In both cases you must attach a photocopy of your ID for identity verification. <\/p>\nLikewise, the User has the right to revoke the consent initially given, and to file claims of rights before the Spanish Data Protection Agency (AEPD).<\/p>\n
Electronic commercial communications<\/h3>\n
In application of the Law of Services of the Information Society, SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A., will not send advertising or promotional communications that have not been previously authorized by the recipients.<\/p>\n
TERMS AND CONDITIONS OF USE MOBILE APPLICATIONS<\/h2>\n\n- 1.<\/strong> These Terms and Conditions of Use regulate the rules to which the use of the “setram fleet mobile” is subject. “SETRAM FLEET MOBILE<\/em><\/strong> (hereinafter referred to as the APP), which can be downloaded from the apple store<\/em> or play store<\/em> platforms.<\/li>\n<\/ol>\n
The download or use of the APP attributes the condition of User to whoever does so, and implies acceptance of all the conditions included in this document and in the Privacy Policy for mobile applications (APPS).<\/p>\n
The User is advised to review these conditions each time he\/she uses the APP, as they may be modified in the future.<\/p>\n
\n- 2.<\/strong> Only Users expressly authorized by SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. may use the APP once downloaded. Users who do not have authorization will not be able to access such content. <\/li>\n
- 3.<\/strong> The User is responsible for payment of all costs or expenses incurred as a result of downloading and using the SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. Application, including any carrier network or roaming charges. Check with your service provider for details. <\/li>\n
- 4.<\/strong> Protection of Personal Information: Please refer to SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A.’s Application Privacy Policy and Application privacy notices to learn what information is collected and the measures taken to protect your personal information.<\/li>\n
- 5.<\/strong> You may not alter or modify any part of the APP or the contents thereof, circumvent, disable or otherwise tamper with (or attempt to circumvent, disable or tamper with) the security or other functions of the program and use the APP or its contents for a commercial or advertising purpose.<\/li>\n<\/ol>\n
Likewise, it is forbidden to use the APP in order to damage property, rights or interests of SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. or third parties. \n- 6.<\/strong> The APP and its contents (texts, photographs, graphics, images, technology, software, links, contents, graphic design, source code, etc.), as well as trademarks and other distinctive signs are the property of SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. or third parties, and the User does not acquire any right over them by the mere use of the APP.<\/li>\n<\/ol>\n
The User shall refrain from:<\/p>\n
a) Reproduce, copy, distribute, make available to third parties, publicly communicate, transform or modify the APP or its contents, except as provided by law or expressly authorized by SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. or by the owner of such rights.<\/p>\n
b) Reproduce or copy for private use the APP or its contents, as well as communicate them publicly or make them available to third parties when this involves their reproduction.<\/p>\n
c) Extract or reuse all or a substantial part of the contents of the PPP.<\/p>\n
\n- 7.<\/strong> Subject to the conditions set out in the previous section, SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. grants the User a non-exclusive, free license to use the APP for personal use and indefinitely. Said license is also granted under the same terms with respect to the updates and improvements made to the application. Such licenses may be revoked by SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. unilaterally at any time, by simply notifying the User. <\/li>\n
- 8.<\/strong> It is up to the User, in any case, to have adequate tools for the detection and disinfection of malicious programs or any other harmful computer element.<\/li>\n<\/ol>\n
SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. is not responsible for any damage caused to computer equipment during the use of the APP.<\/p>\n
Likewise, SERVICIOS DE TRANSPORTES DE AUTOM\u00d3VILES Y MERCANC\u00cdAS, S.A. shall not be liable for damages caused to Users when such damages are caused by failures or disconnections in telecommunications networks that interrupt the service.<\/p>\n
\n- 9.<\/strong> These Terms of Use may be modified at any time without notice to the User. Continued use of the application after any such modification shall constitute acceptance by the User of such modifications. <\/li>\n
- 10.<\/strong> The User is solely responsible for the use of the application.
